Hosting a Super Bowl viewing party is a lot more than having some cold ones and ordering wings as the Kansas City Chiefs play the San Francisco 49ers.
It’s about responsibility.
Just ask Toronto personal injury lawyer Jasmine Daya, who makes hosting the event sound a good deal more complicated from a legal perspective.
“There’s usually a lot of alcohol flowing — that’s what causes the issues,” said Daya.

“When people are intoxicated and they injure themselves as a result — either within your home, outside your home or after they leave your home — you need to make sure they get home safely.”
She breaks it down amongst these major points:
SOCIAL HOST LIABILITY
“If you’re hosting a Super Bowl party, then you are known in law as a social host and with that comes responsibility,” Daya said, so get rid of any exterior/interior hazards in your home.
“Any issues that arise as a result of hosting a party creates potential liability for the social host.“
LEGAL LIABILITY PERSPECTIVE
“(Drunk guests who get injured) could commence a civil lawsuit against the homeowner,” Daya said. “So if the homeowner has insurance, hopefully the claim will be covered. However, if the injury is catastrophic, the homeowner could be personally liable after the insurance limits are exhausted.”
“One of the things I’ve been suggesting lately to individuals that are hosting parties is to consider hiring a bartender,” Daya said. “It may seem quite extravagant, but actually there’s a lot of very reasonably priced individuals that will come and bartend at your home. And it takes the onus off of you to watch over your friends.
“On top of that, bartenders are SmartServe certified. And that means they have the requisite training to monitor what an individual does or how they behave once they’re intoxicated.”
“You want to make sure that people haven’t driven and if they have driven to your home,” she said, “then you want to make sure that they’re OK to drive home by taking away keys, by making sure another friend is designated to watch over people, ensure there are designated drivers. Suggest rideshares or taxis.”
